“It has become a specialized niche practice because those of us who have been doing it have been doing it for a very long time,” Mr. Branham said. “And the knowledge of what is critical both in terms of evidence, of exposures and the history, of how to prove the negligence—or, in particular cases, the willfulness—of a particular product manufacturer or premise [defendant] or contractor is something that’s been developed over time.”
